§ 224.02. FREEDOM OF INFORMATION ACT COORDINATOR.

  • (a)

    The City Clerk is hereby appointed the Freedom of Information Act Coordinator.

    (b)

    Requests for access of records shall be made in writing and remain on file at the office of the City Clerk. The City Clerk shall examine each request to determine whether the record requested is a public record or subject to exemption from disclosure by the Michigan Freedom of Information Act, and respond not more than five days after the date the request is received or as otherwise provided by law by one of the following:

    (1)

    Grant the request;

    (2)

    Issue a written notice to the requesting party denying the request;

    (3)

    Grant the request in part and issue a written response denying the request in part; or

    (4)

    Issue a notice extending the period during which the public body shall respond to the request and set forth the reason for the extension.

    (c)

    If the City Clerk denies a request for a public record in whole or in part, the written notice shall contain the following:

    (1)

    The basis for determining that the requested record is exempt from disclosure; or

    (2)

    Certification that the public record does not exist under the name given or by another name reasonably known to the City; and

    (3)

    A statement that the requesting person has a right to judicial review of the decision as provided by the act.

    (d)

    A fee of providing a copy of a public record shall be established from time to time by the Coopersville City Council.
