§ 1046.02. DEFINITIONS.

  • As used in this chapter:

    (a)

    Commercial User . "Commercial user" means any user which is neither an industrial user nor a residential user.

    (b)

    Industrial User . "Industrial user" means any nongovernmental, nonresidential user of the systems which discharges more than the equivalent of 25,000 gallons per day (gpd) of sanitary wastes and which is identified in the standard Industrial Classification Manual, 1972, Office of Management and Budget, as amended and supplemented, under one of the following divisions:

    Division A - Agriculture, Forestry and Fishing

    Division B - Mining

    Division D - Manufacturing

    Division E - Transportation, Communication, Electric, Gas and Sanitary Services

    Division I - Services.

    (c)

    Operation and Maintenance Cost . "Operation and maintenance cost" means the cost to operate and maintain the systems and treatment plant plus replacement cost

    (d)

    Person . "Person" means any individual, partnership, copartnership, firm, company, corporation, association, joint stock company, trust estate, governmental entity or any other legal entity or its legal representatives, agents or assigns.

    (e)

    Replacement Cost . "Replacement cost" means expenditures for obtaining and installing equipment, accessories or appurtenances which are necessary during the useful life of the systems and the treatment plant to maintain the capacity and performance for which the systems and treatment plant were designed and constructed.

    (f)

    Residential User . "Residential user" means a user whose premises or buildings are used primarily as a permanent domicile for one or more persons and who discharges only domestic waste. "Residential user" does not include transitory lodging such as motels, hotels and motor inns.

    (g)

    Sewer Debt Service Charge . "Sewer debt service charge" means a charge levied on the users of the sewer system for the user's proportionate share of the principal and interest payable on all indebtedness issued to finance the acquisition of the sewerage system and the treatment plant.

    (h)

    Sewer Service Charge . "Sewer service charge" means the sum of the sewer user charge and the sewer debt service charge.

    (i)

    Sewer System . "Sewer system" means all sanitary sewer lines, lift stations, pumping facilities, sanitary sewer collection facilities and their appurtenances which the City has or shall have possession of and operating responsibility for (whether owned by the City or not), either now in existence in the City or hereafter acquired or constructed in the City, together with all works, plants, instrumentalities and properties used or useful in connection therewith in collecting sanitary sewerage and transmitting and conveying such collected sanitary sewage to sanitary sewage disposal facilities, and all extensions, enlargements and improvements thereto in the City.

    (j)

    Sewer User Charge . "Sewer user charge" means a charge levied on the users of the sewerage system for the user's proportionate share of the cost of the operation and maintenance (including replacement) of the sewerage system and treatment plant.

    (k)

    Stub . "Stub" means the lateral line from the main to the user's property line.

    (l)

    Systems . "Systems" means the sewerage system and the water system.

    (m)

    Treatment Plant . "Treatment plant" means the City of Coopersville Wastewater Treatment Facilities.

    (n)

    User Charge System . "User charge system" means the system of charges levied on users of the systems or either system.

    (o)

    User Class . "User class" means the classification (residential, commercial or industrial) into which each user is categorized.

    (p)

    Water Debt Service Charge . "Water debt service charge" means a charge levied on the users of the water system for the user's proportionate share of the principal and interest payable on all indebtedness issued to finance the acquisition of the water system.

    (q)

    Water Service Charge . "Water service charge" means the sum of the water user charge and the water debt service charge.

    (r)

    Water System . "Water system" means all water lines, water storage tanks, pumping stations and appurtenances which the City has or shall have possession of and operating responsibility for (whether owned by the City or not), either now in existence or hereafter acquired or constructed by the City, together with all works, plants, instrumentalities and properties used or useful in obtaining, transmitting and distributing water, and all extensions, enlargements and improvements thereto.

    (s)

    Water User Charge . "Water user charge" means a charge levied on the users of the water system for the user's proportionate share of the cost of the operation and maintenance (including replacement) of the water system.
